Post Bankruptcy Discharge Injunction
After you have filed for bankruptcy and receive your "discharge" under Section 524 of the U.S. Bankruptcy Code, creditors can no longer contact you in any way about a debt included in your Bankruptcy case. Your discharge is a permanent court injunction prohibiting creditors from enforcing certain obligations against you, the Debtor. Unfortunately, many creditors think they can violate this law without consequence. Violations of the Discharge injunction include:
- letters
- phone calls
- threats of a criminal proceeding or any other adverse action
- failing to release information based on your bankruptcy filing
Violating the bankruptcy discharge is a serious matter. If you receive contact from a debt collector concerning a discharged debt, notify us immediately so we can stop creditors from harassing you
